The Whistleblower Protection Act ("HinSchG") is the German implementation of the so-called EU Whistleblower Directive (Directive (EU) 2019/1937 of the European Parliament and of the Council of the European Union of October 23, 2019) for the protection of persons who report violations of Union law. The aim of the Whistleblower Protection Act is to protect whistleblowers who expose themselves to the risk of retaliation. It ensures the protection of persons who report certain violations of legal provisions or suspicions of such violations.

EBAWE Anlagentechnik GmbH (hereinafter referred to as "EBAWE") maintains an internal whistleblower protection system in the form of a digital whistleblower system. EBAWE uses the following reporting channel for this purpose:

You can use this encrypted platform to report certain violations of legal provisions (e.g. violations subject to criminal penalties or fines as well as other violations of federal and state legislation and directly applicable legal acts of the European Union and the European Atomic Energy Community) of which you have become aware in a professional context.

You can decide whether you want to share your personal data with us or report it anonymously. In any case, the confidential treatment of your identity and your personal data is guaranteed.

Data protection information for whistleblowers.

Whistleblowers do not have to fear any disadvantages if the report was made in good faith. Reprisals against the whistleblower will not be tolerated at any time.

EBAWE has appointed the experienced lawyers Dr. Detlev Heinsius and Markus Gerhardt from the law firm RSM Ebner Stolz Mönning Bachem Wirtschaftsprüfer Steuerberater Rechtsanwälte Partnerschaft mbB as ombudspersons to receive reports via the whistleblower system.

You will receive a confirmation of receipt generated by the system within 7 days of receipt of your notification. The confirmation will also include a code that you will need for any follow-up activities. Within the following three months, you will receive written feedback from the person responsible for the internal reporting channel.

In addition to our internal whistleblower system, it is possible to contact an external reporting office directly without having to fear any disadvantages.

According to the legal requirements, the whistleblower should give preference to the internal whistleblower system, provided that effective action against the violation is guaranteed and no reprisals are to be feared. 

We expressly point out that such external reporting offices are being set up, for example, at the Federal Office of Justice, the Federal Financial Supervisory Authority (BaFin) and the Federal Cartel Office.

There is also the option of reporting to European Union institutions, bodies, offices and agencies.
